How it works

How a connection process is handled

Connection conditions and a connection agreement bind the project for years, so the allocation of deadlines and liability decides the outcome. Four steps.

  1. Project review

    We establish the configuration of the installation, the intended connection point and the key deadline and cost risks.

  2. Connection conditions

    We review the conditions issued by the operator and confirm that they are consistent with the commissioning schedule of the project.

  3. Agreement and negotiations

    We review the draft connection agreement, prepare amendments and support the negotiations with the operator within the agreed scope.

  4. Final version

    We prepare the agreed final version and explain the obligations that apply throughout the term of the agreement.

Who needs this service

This service is for investors and operators of renewable installations that must be connected to the grid before energy production can start. Work can begin with the application for connection conditions, with the conditions already issued by the operator, or with a draft connection agreement awaiting signature. A quotation is agreed before any work starts and a consultation is not required.

Connection conditions and the agreement

The connection agreement governs the relationship with the distribution system operator (OSD), covering in particular the deadline, the connection fee, the scope of works and liability, under article 7 paragraph 2 of the Polish Energy Law. Its function is separate from the sale or financial settlement of energy. Where a project covers both, we check that the connection deadlines are consistent with the date from which energy is to be delivered, and what follows from a delay.

Scope of the review

We compare the capacity, the connection point and the metering arrangements in the operator documents with the technical assumptions of the project. We set out the obligations of each party, the consequences of a delay on either side, the settlement of the connection fee and the rules for changing the agreed parameters. Where a question calls for a network study or a technical opinion, we say so instead of replacing it with a legal assessment.

Limits of the scope

Legal work does not include the technical design, a network study or the selection of protection equipment, and it does not guarantee that connection conditions will be issued. Preparing the technical application, obtaining permits or a generation licence and conducting proceedings or disputes require a separately agreed scope. Tax advice is agreed and priced separately.

What the fee depends on

  • Complexity of the connection conditions and of the technical configuration
  • Number of negotiation rounds with the operator
  • Whether the project also covers a power purchase agreement

We agree the fee individually, at an hourly rate or as a flat fee, and confirm it before we start.
